Rules

To create your profile, you must satisfy all of the following conditions.

• You are:
  • at least 18 years old or the age of majority under the laws of your country.
  • legally permitted to use the app under the laws of your country.
• You have never:
  • committed, been convicted of, or pled no contest to a sex crime, a violent crime, or a felony.
  • registered or required to register in the past, are currently registered, or will register or require to register in the future, in any sex offender registry.
• You are not:
  • listed on any United States list of prohibited or restricted parties.
  • located in a country that is subject to United States embargos or sanctions.
  • located in a country that is designated by the United States as a terrorist supporting country.

To use the app, you agree to all of the following conditions.

• You will:
  • use your real age, real picture, real gender identity, and real sexual orientation.
  • use the app only for the purpose of finding a date for yourself.
  • comply with all applicable laws, including privacy laws, intellectual property laws, and anti-spam laws.
• You will not:
  • misrepresent your identity, personal status, qualifications, or affiliations.
  • disclose information that you do not have permission or consent to disclose.
  • be dishonest, abusive, or discriminatory.
  • stalk or harass anyone.
  • engage in solicitation or prostitution.
  • create or operate a pyramid scheme, fraud, scam, or other offenses.
  • copy user profiles and other data from the app or its services.
  • scrape or replicate any part of the app or its services.
  • access areas of the app to which you do not have permission.
  • develop, support, or use scripts, bots, crawlers, plugins, or similar software to exfiltrate data from the app or its services.

We reserve the right to delete or deactivate your profile without notice or explanation. If your profile is deleted or deactivated, you will not receive refunds for expenses you incurred while using the app. We reserve the right to investigate your profile for violations of the Terms. We reserve the right to report your profile to law enforcement agencies.

We do not verify personal backgrounds, professional backgrounds, medical records, sexual history, sex offense status, criminal history, or financial records of the app users. We do not make any representations of the app users. You are solely responsible for all your interactions with the app users.

You agree to, and hereby do release us, our service providers and our successors from any claims, demands, losses, damages, rights, and actions of any kind, including personal injuries, death, and property damage, that directly or indirectly arise from you using the app or your interactions with the app users. If you are a California resident, you hereby waive California Civil Code Section 1542.

Content

The app contains user content uploaded by the app users including you. To use the app, you agree to all of the following conditions.

• You are responsible and liable for your user content.
• You represent that you have all necessary rights to and licenses for your user content.
• You do not have any rights to other’s user content.
• You will only view other’s user content and perform no other action.
• If you reveal any information about yourself in your user content, you will be doing so at your own risk.
• You indemnify, defend, release, and hold us harmless from any claims made in connection with any user content.
• You grant us permission to store your user content across any national or international databases we choose.

In your user content, you will not put anything that:

• has offensive language or offensive imagery.
• harasses, upsets, embarrasses, alarms, or annoys anyone.
• is abusive, insulting, or threatening to anyone.
• is defamatory or libelous to anyone.
• involves children and minors.
• is harmful to children and minors.
• is discriminatory based on race, color, ethnicity, national origin, religion, disability, sexual orientation, gender expression, gender identity, or physical appearance.
• promotes or encourages racism, sexism, hatred, or bigotry.
• promotes or encourages violence, terrorism, or illegal activity.
• constitutes committing a criminal offence.
• relates to commercial activities.
• constitutes transmission of junk data or spam data.
• infringes any third-party rights.
• impersonates another person.
• shows another person without that person’s permission or consent.
• has contact information, such as addresses, postal codes, zip codes, telephone numbers, email addresses, social media handles, URLs, and other such information either in relation to you or another person or entity.
• has personal identifiable information, such as names, social security numbers, tax identification numbers, insurance policy numbers, health care account numbers, and other such information either in relation to you or another person or entity.
• has financial information, such as bank account numbers, credit card numbers, debit card numbers, digital wallet and currency account numbers, crypto currency account numbers, and other such information either in relation to you or another person or entity.

App content

The app contains app content that is native to the app. Any content which is not user content, is app content. This includes but is not limited to graphics, user interfaces, trademarks, logos, sounds, artwork, and other intellectual property appearing on the app. App content is owned, controlled, or licensed by us and is protected by copyright, trademark rights, data rights, database rights, and/or intellectual property laws. All rights and titles to and interests in app content always remains with us. To use the app, you agree to all of the following conditions.

• You will not:
  • sell, modify, or distribute app content.
  • create derivative works from app content.
  • scrape, disable, decompile, or analyze app content.
  • commercially exploit app content.
  • use app content for unlawful purposes.

Any user content or app content not specifically mentioned or limited by the Terms shall not be construed to be permissible content.

Child sexual abuse material

Payments

The app implements a pay-per-match approach, wherein users can purchase matches as needed. The app has several clubs, and each has an entry fee. Purchasing matches and paying club entry fees are in-app payments. The Apple App Store and the Google Play Store manage all in-app payments. You will be responsible for all taxes associated with your purchases and payments. All payments are final and non-refundable.

Notifications and geo-location

The app will receive push notifications. The notifications will be sent and received automatically based on your phone and the app settings. You will be responsible for all charges incurred in transmitting and receiving push notifications.

The app will determine your geo-location using one or more reference point data, such as GPS, IP address, Bluetooth, or related software within your mobile device. You will be responsible for all charges incurred in transmitting and receiving geo-location data.

Disclaimer

The app, app content, and user content are all provided to you without warranty of any kind. We do not guarantee that the app will work uninterrupted, secure or error free. We do not guarantee that the app, app content, or user content is correct or reliable. You will be using the app at your own risk. You are solely responsible for your interactions with the app users. We are not responsible for the conduct of the app users.

Limitations of liability

We and our service providers will not be liable for any damages, direct, indirect, incidental, consequential, special, or punitive, including without limitation to loss of data, income, profit or goodwill, loss of or damage to property and claims of third parties arising from you using the app, app content, or user content, however caused, whether based on breach of contract, tort, proprietary rights infringement, product liability or otherwise.

The foregoing shall apply even if we were advised of the possibility of such damages. If you become dissatisfied in any way with the app, your sole and exclusive remedy is to stop using the app.

You hereby waive all claims arising from you using the app. Because some states do not allow the disclaimer of implied warranties or the exclusion or limitation of certain types of damages, these provisions may not apply to you. If any portion of this limitation of liability is found to be invalid or unenforceable for any reason, then our aggregate liability shall not exceed one hundred US dollars ($100).

The limitation of liability herein is a fundamental element of the basis of the bargain and reflects a fair allocation of risk. The app would not be provided without such limitations, and you agree that the limitations and exclusions of liability, disclaimers and exclusive remedies specified herein will survive even if found to have failed in their essential purpose.

Indemnity

The actions you take and information you post on the app are your responsibility. You agree to indemnify, defend, and release us and our service providers against and from all claims, damages, actions, proceedings, demands, liabilities, costs, and expenses incurred by us.

We retain the exclusive right without your permission or consent, to settle and pay all claims which are brought against us. If we ask, you will cooperate fully with us in our defense of any claim.

Changes

We may modify, amend, or change the Terms at any time. Your continued use of the app following any change constitutes your acceptance of the change and you agree to updated Terms. If you do not accept any changes to the Terms, you should stop using the app immediately.
